1. Acceptance
By creating an account or using Earmarqer (“the Service”), you agree to these Terms. If you do not agree, do not use the Service.
2. Invite-only access
Earmarqer is an invite-only personal tool operated by Brett Webb. Access is granted at our sole discretion and may be revoked at any time, with or without notice.
3. Your account
You are responsible for keeping your password confidential and for all activity under your account. Notify us immediately at contact@brettwebb.com if you suspect unauthorized use.
4. Acceptable use
You agree not to use the Service to: (a) violate any law; (b) post or store content that infringes intellectual property rights; (c) distribute spam, malware, or other harmful code; (d) attempt to gain unauthorized access to other accounts or systems; or (e) interfere with the Service’s operation.
5. Content you save
You retain all rights to bookmarks, notes, and tags you save. By marking a bookmark public, you grant other Earmarqer users the right to view that bookmark and its associated metadata. We do not claim ownership of your content.
6. Termination
We may suspend or terminate your account at any time, particularly for violations of these Terms or abuse of the Service. You may request account deletion at any time by emailing contact@brettwebb.com.
7. Disclaimer of warranties
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that data will not be lost.
8. Limitation of liability
To the fullest extent permitted by law, Brett Webb shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of or inability to use the Service.
9. Changes to these Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
10. Governing law
These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules.
